THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED BY KLARA AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
At various locations on our Site, such as when you contact us, we, or in the case of payment our third-party credit card processor, may request that you supply us with personally identifiable information (e.g., name, e-mail address, postal addresses, home, work and/or mobile telephone number, birth date, gender and/or credit card information) (herein referred to “Personal Information”). If you do not want your Personal Information collected, please do not submit it to us through this Site. If you do not want to give us any Personal Information, you can choose not to use these features of our Site.
When you do provide us with Personal Information, we use your Personal Information for five general reasons. First, we use Personal Information to provide you with the services that you request. Second, we may use your Personal Information to send you information and marketing communications about Klara and Klara’s Services including brief questionnaires that will help us improve delivery of services to you. Third, we may use your information in aggregate, de-identified form to help us evaluate and modify our website and other related services or related marketing materials. Fourth, we may disclose your information in aggregate, de-identified form to our partners who are conducting statistical research and analysis on various health issues; these partners may include pharmaceutical manufacturers, clinical research entities, educational institutions, insurance companies, and data processing companies. Fifth, we may use and disclose your Personal Information to the extent such use or disclosure is consistent with your authorization.
If you register for announcements or for information about Klara, you may choose to “opt-out” of receiving further contact or solicitations from Klara by e-mailing email@example.com. When contacting us by e-mail, please insert “UNSUBSCRIBE” in the subject line and the body of the message. Please note that even if you opt-out, we may still send you certain Klara and Klara Service-related communications.
Klara takes its responsibility to protect your Personal Information seriously. Accordingly, Klara shares your Personal Information in only the following circumstances:
Operations and Maintenance Contractors. Klara may share your Personal Information with third parties as is necessary to provide services to you or respond to your requests for products and information, unless you have opted-out of receiving information. If you do not opt-out, third-party contractors may access your Personal Information to send you this information on behalf of Klara. Klara may also hire third-party technology providers to host this website and to store your Personal Information provided to Klara.
Legal Authorities. Klara may disclose Personal Information when required by law or legal process; when necessary to protect and defend the rights or property of Klara; or when necessary to protect the personal safety of Klara’s website users and customers.
Aggregate Information. Aggregate information maintained by Klara does not contain any Personal Information about our users. For any aggregate information transmitted to an authorized third-party, any information that may be considered protected health information is de-identified and discarded before the information is transmitted. From time to time, Klara may share aggregate, non-identifiable information about website usage with third parties, including government agencies and advertisers.
Klara is a platform for individuals over the age of eighteen (18). If you are a minor or a representative of a minor, please do not attempt to use this Site or provide any Personal Information about yourself to us. Klara does not knowingly collect or maintain personal information from children under the age of eighteen (18) or send them requests for personal information. If you are under the age of eighteen (18), you should not provide us with any identifiable information about yourself. If we learn that personally identifiable information of persons under eighteen (18) years of age has been collected on the Site, we will take the appropriate steps to delete this information as quickly as possible.
We may use “cookies” – small pieces of data or text files that are stored on your computer tied to information about you. This information will help us enhance your experience on the Site (e.g., the option of saving your username and password for the Site by placing a cookie on your personal computer). Cookies can store non-personally identifiable information, such as what websites, pages, or advertisements your browser has accessed and may be tied to the personal information you knowingly choose to provide to us.
When you provide us with your e-mail address pursuant to a donation or if you subscribe to our e-mail list or electronic newsletter, we may share your e-mail address with certain third party charities, and other entities consistent with our mission that we believe may be of interest to you. When contacting us by e-mail, please insert “UNSUBSCRIBE” in the subject line and the body of the message. If you unsubscribe, you should assume that your request has been received and is being processed. Please allow ten (10) business days from when the request was received to complete the removal of your e-mail address from our database as some of our promotions may have been in process before submitting such request. We will make reasonable efforts to discontinue e-mail communications as soon as possible.
Though we make every effort to preserve user privacy, we may need to disclose information as required by law, rule or regulation or where we have a good-faith belief that such action is necessary to protect Klara’s rights and/or to comply with a judicial proceeding, court order, as requested by a governmental or law enforcement authority, or other legal process. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.
You hereby acknowledge that Klara is a software provider, and you acknowledge that Klara is not a medical provider. Klara is a Business Associate, as defined under the Privacy, Security, Breach Notification, and Enforcement Rules at 45 CFR Part 160 and Part 164 ( “HIPAA”), and Klara maintains reasonable security measures - including encryption, granular access controls, and privacy and security training - to protect against the loss, misuse, and alteration of information on its Platform, in accordance with HIPAA. However, it is not possible to guarantee the security or integrity of information disclosed online. As no data transmission over the Internet is completely secure, we urge you to take every precaution to protect your personal data when you are sending Personal Information on the Internet. Because no physical or electronic security is impenetrable, by using the Site, you agree to assume all risks in connection with the information sent to us or collected by us when using the Site.
As a convenience to our visitors, the Site may contain links to other websites that we believe may offer useful information. When you click on one of these links, you will be transferred from the Klara Site to the website of the organization or company that you selected. Each of these linked sites maintains its own independent privacy policies and procedures, which you should consult before providing any of your Personal Information. While we aim to work with trusted partners and organizations that are bound by the same state and federal laws governing information privacy and security, please be aware that we are not responsible for the privacy practices of other websites. We encourage you to be aware that you are leaving our Site and to read the privacy statements of every website that collects Personal Information. This Policy applies solely to Personal Information collected by our Site and does not cover Personal Information collected elsewhere, including without limitation on websites linked to from the Site.
We will not make the content of the data collected using our APIs or plugins available to the public, or share it with anyone else, except as necessary to provide data to the relevant API service. If we need to use a third-party vendor to assist with collection data through an API or plugin, that vendor will be under appropriate security and confidentiality contractual obligations.
We use outside sources to verify a user’s account credentials to validate that user’s access to our system.
A user may demand access to, request corrections of, ask for deletions concerning, or refuse to provide Klara Personal Information to use or collect by contacting Klara at its postal address (85 Broad Street, New York, NY 10004) or e-mail address (email@example.com) and requesting such modification to user’s account.
The Site may offer web logs, web postings, bulletin boards, chat rooms, newsgroups, or other forums which permit users to interact with each other online. Any information you transmit online in such forums is public and Klara is not responsible for third parties’ usage of the information you provide.
